Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website, software, tools, and services offered by Spinor Innovations LLC, doing business as Magmira ("Magmira," "Company," "we," "us," or "our") at https://magmira.com.

By accessing or using Magmira, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years of age and able to enter into a legally binding agreement to use the Services.

By using the Services, you represent and warrant that you meet this age requirement and that all information you provide is accurate.

The Services are not intended for anyone under 18. If we learn that we have collected information from someone under 18, we may terminate access and delete associated information as described in our Privacy Policy.

2. Services and Service Scope

Magmira provides job search strategy, resume positioning, and application submission services on behalf of clients. For application plans, Magmira consultants prepare and submit job applications on your behalf using information, accounts, and credentials you provide, supported by artificial intelligence tools and human review where your plan includes it.

Client accounts, not proxy emails: Magmira does not provide separate proxy email inboxes for job applications (unlike some other services). Applications are typically submitted using your email address and accounts, as authorized by you during onboarding.

Services may include resume support, resume rewriting, LinkedIn profile optimization, job search support, interview preparation, career coaching, application support, AI-assisted tools, and related professional services.

All content submitted on behalf of clients is based solely on information provided by the client. Magmira does not invent, fabricate, or embellish professional experience, credentials, or qualifications. Clients are responsible for ensuring the accuracy of all information they provide.

Before work begins, we align with you on target roles (job tracks), geographic scope (locations you are willing to work in), work authorization or visa constraints, and the service plan you purchased. We perform services only within that agreed scope.

Detailed plan limits, deliverables, and exclusions are described in Section 4 below. By purchasing a plan or using application services, you agree to those limits.

2.1 Not legal, immigration, or licensed career advice

Magmira provides job search and application services. We are not a law firm, immigration law firm, or government agency. Information we provide about visas, work authorization, or hiring practices is general and based on what you tell us — it is not legal or immigration advice. You are solely responsible for your work authorization, visa compliance, and eligibility for roles you ask us to pursue.

2.2 Marketing summaries; Terms control

Website pages (including plan summaries and the Career Partner page) describe our Services in summary form to help you understand what we offer. They are not a complete list of limitations or exclusions. If anything conflicts with these Terms — especially Section 4these Terms control.

We may update, modify, suspend, or discontinue any part of the Services at any time.

3. No Employment, Interview, or Offer Guarantee

Magmira does not guarantee employment, interviews, job offers, salary increases, recruiter responses, promotions, visa sponsorship, immigration approvals, or any particular timeline to receive an offer.

We commit to quality execution of the services described in your plan and in Section 4. Refund eligibility is governed by our Refund Policy. The Refund Policy is not a money-back guarantee based on job search outcomes, time to offer, or number of interviews received.

Any examples, testimonials, metrics, or success stories are illustrative only and do not guarantee future results. Individual results vary based on market conditions, role demand, location scope, experience, and other factors outside Magmira's control.

3.1 Fixed engagements — not "until you get hired"

Unless we agree otherwise in writing, Magmira plans run for a defined period or deliverable scope (for example, 100 applications, 200 applications, or a 3-month Career Partner engagement). Services conclude when that period or scope is complete, regardless of whether you receive interviews or offers.

Career Partner is a fixed 3-month engagement. It does not continue without a new agreement if your search takes longer, and it is not a "services until you accept an offer" program.

3.2 No outcome-based promises

Nothing on our website, in sales conversations, or in consultant communications creates a guarantee of interviews, offers, compensation, or hire dates. If you need clarification on what your plan includes, refer to Section 4 and your written engagement confirmation.

3.3 The Magmira Quality Commitment

What we do not promise: Magmira does not guarantee a specific employment outcome. No legitimate service can guarantee interviews, job offers, or hire dates. Individual results vary based on market conditions, role demand, location scope, experience, and other factors outside Magmira's control.

What we commit to deliver:

  • Every application we send on your behalf will be thoughtfully prepared, human-reviewed (where your plan includes applications), and tailored to the role using your real, accurate experience
  • Honest positioning based on information you provide — we do not invent credentials, skills, or employment history
  • Services performed within the job tracks, locations, and scope agreed at onboarding, as described in Section 4

Quality revision (first 7 days): If you are not satisfied with the quality of deliverables in the first 7 days after delivery, notify us at hello@magmira.com per our Refund Policy and we will revise at no extra charge. This commitment addresses work quality, not job search outcomes, interview volume, or time to offer.

Marketing pages and plan summaries describe our Services at a high level. Section 4 and this Section 3 define binding scope, limitations, and exclusions.

4. Service Plans, Scope, and Limitations

This section defines what Magmira does and does not do under each service plan. Pricing pages summarize plans; this section is the binding definition of service scope.

4.1 Included in every Magmira plan

  • Honest positioning based on your real experience — we do not invent credentials
  • Human review on deliverables and applications (where your plan includes applications)
  • Clear scope agreed before work begins: target roles, locations, and visa constraints
  • Async communication and progress updates appropriate to your plan
  • For application plans: use of your authorized email and job accounts (not Magmira proxy inboxes) to submit applications and receive employer responses, as described in Section 6

4.2 What Magmira never does

  • Mass-applying the same resume to hundreds of roles without role-specific tailoring
  • Applying to roles outside your agreed job tracks or locations without your approval
  • Contacting hiring managers or recruiters on LinkedIn (or other channels) on your behalf
  • Guaranteeing interviews, offers, or hire dates
  • Writing false experience, skills, or employment history
  • Submitting applications on your behalf before you approve your master resume and targeting scope
  • Managing applications for unrelated role types beyond your plan's job-track limit

4.3 Job tracks

Each plan limits how many distinct career paths ("job tracks") we target. Within a track, you may list up to three closely related title variants (for example, "Product Manager" and "Senior Product Manager"). Job-track limits by plan:

  • Foundation: 1 job track (up to 3 related titles) — positioning only; no applications
  • Momentum: 1 job track (up to 3 related titles)
  • Concierge: up to 2 job tracks
  • Career Partner: up to 3 job tracks

We do not apply across unrelated role types beyond these limits unless you upgrade your plan or agree to a written change in scope.

4.4 When applications begin (all application plans)

For Momentum, Concierge, and Career Partner — any plan that includes submitting applications on your behalf — applications do not begin on your payment date.

The typical sequence is:

1. Onboarding and intake (roles, locations, visa constraints, and plan scope)

2. Master resume, LinkedIn work (where included), and targeting strategy prepared

3. Final strategy review with you — you approve your master resume, job tracks, locations, and related materials

4. You provide required email and job-platform credentials and Google Drive access (Section 6)

5. Applications begin only after that approval, typically within 1–2 weeks of the final strategy review

Foundation does not include applications. Foundation deliverables follow a separate timeline agreed at kickoff (typically 2–3 business days from completed intake).

Timelines may extend if you need additional revision rounds, delay feedback, or have not yet provided working credentials or Drive access. Those delays are not a failure by Magmira to perform the Services.

Unless we agree otherwise in writing, your application period (for example, a 100-application sprint, 200-application engagement, or the 3-month Career Partner window) starts when we submit the first application after final approval — not on your payment date.

4.5 Geographic scope and application volume

Application volume depends on the geographic scope you approve during onboarding. We only submit applications when a role is a strong fit within your agreed markets. We do not pad application counts with low-quality or irrelevant roles.

Focused scope (1–2 metro areas): Fewer local openings, especially for niche roles. Momentum and Concierge deliver their stated application caps when sufficient quality matches exist; pacing may be slower if openings are limited. Career Partner maintains an active pipeline for the full engagement period, but weekly volume may be lower than for broader scope.

Regional scope (3–5 metros or one region): Moderate pool of roles; typical pacing for fixed-cap plans.

US-wide scope (remote US and/or willingness to consider all US locations you approve): Largest pool of roles. Fixed-cap plans (Momentum, Concierge) can reach their stated totals more readily. Career Partner's full-pipeline coverage is most meaningful at this scope.

If you narrow location scope after work has begun, application volume may decrease accordingly. That is an expected result of market size, not a failure to perform services.

4.6 Plan-specific deliverables

Foundation (strategy and assets only)

  • *We do:* master resume, LinkedIn rewrite, Role-Aware positioning for one career path, async intake, and optional strategy call
  • *We do not:* submit applications, conduct outreach to hiring managers or recruiters, or provide interview prep beyond the optional strategy call

Momentum (100 applications per sprint)

  • *We do:* everything in Foundation, plus up to 100 tailored applications per sprint, human review before each submission, and weekly progress updates
  • *We do not:* exceed 100 applications in a single sprint, apply outside approved locations or job tracks, perform LinkedIn outreach, or provide dedicated interview prep for each call

Concierge (200 applications per engagement)

  • *We do:* everything in Momentum with up to 200 applications per engagement, biweekly strategy calls to review progress and search strategy, interview prep guidance, and a dedicated strategist
  • *We do not:* exceed 200 applications without a new agreement, add job tracks beyond your plan limit, perform LinkedIn outreach or messaging to hiring managers or recruiters on your behalf, guarantee interview invitations, or continue indefinitely beyond the engagement period

Career Partner (3-month full partnership)

  • *We do:* everything in Concierge for a fixed 3-month period, maintain your application pipeline while quality in-scope roles exist (no arbitrary cap at 100 or 200), LinkedIn profile optimization (headline, about, experience framing, and recruiter-search keywords — not outreach), periodic strategy reviews, and a dedicated strategist partnership
  • *We do not:* mass-blast low-fit roles to inflate counts, contact hiring managers or recruiters on your behalf, apply outside agreed tracks, locations, or visa constraints, promise a minimum weekly application count regardless of market fit, or extend beyond 3 months without a new engagement

4.7 Career Partner — "full pipeline" defined

The Career Partner plan provides full application pipeline coverage for a fixed 3-month period. It is not a fixed application count like Momentum (100) or Concierge (200).

"Full pipeline" means Magmira continues to prepare and submit tailored, human-reviewed applications while quality roles exist within your agreed job tracks, locations, and quality standards. It does not mean:

  • applying to every job posting regardless of fit;
  • guaranteeing a minimum number of applications per week; or
  • unlimited applications outside your agreed geographic and role scope.

Magmira may pace applications to maintain quality. Clients who target a single metro and a narrow role will naturally receive fewer applications than clients open to US-wide remote work across the same period. Both outcomes are consistent with this plan when services are performed within the agreed scope.

The Career Partner engagement ends at the conclusion of the 3-month period (or earlier if terminated under these Terms). It does not automatically extend because you have not yet received an offer. A new engagement or upgrade requires a separate agreement and payment.

5. Your Responsibilities

You agree to provide accurate, complete, and truthful information.

You are solely responsible for the accuracy of your resume, employment history, education history, certifications, work authorization, visa status, account credentials, and any information submitted through the Services.

You must review all final materials before they are used or submitted.

Where your plan requires it, you must provide timely access to working email and job platform credentials and to a shared Google Drive folder so Magmira can perform the Services.

6. Application Support, Account Access, and Authorization

If you purchase services involving application assistance or submission, you authorize Magmira and its consultants, contractors, and service providers to perform the following on your behalf and at your direction, solely to provide the Services:

  • Prepare, tailor, and upload resumes, cover letters, and application materials
  • Complete application fields on employer career sites, job boards, and applicant tracking systems ("ATS")
  • Sign in to job search accounts you provide using credentials you supply
  • Submit applications using your email address and profile information
  • Click "accept," "agree," or similar controls to accept employer, job board, or platform terms when required to complete an application you have directed us to submit
  • Access and monitor email accounts you designate so we can track employer responses, interview requests, and application-related communications
  • Store and organize deliverables in Google Drive folders you share with us

6.1 Credentials you provide

For application plans, you may be asked to provide login credentials for email accounts and job platforms (such as email passwords, portal passwords, or related access details). You authorize Magmira to use these credentials only to perform the Services within your agreed scope.

You represent that:

  • You own or have lawful authority to use each account and credential you provide
  • You have the right to authorize Magmira to access those accounts and accept applicable third-party terms as described above
  • You will provide accurate credentials and promptly update us if they change
  • You will not provide credentials for accounts belonging to another person without their authorization

You remain solely responsible for all activity conducted through your accounts, including applications submitted at your direction, and for compliance with the terms of each platform.

6.2 Google Drive and file sharing

You may be asked to share a Google Drive folder (or similar cloud folder) with your Magmira consultant so we can deliver resumes, tailored versions, job descriptions, and related materials. You authorize Magmira to access, upload, organize, and store files in folders you share for this purpose.

You control sharing permissions and may revoke folder access at any time. Revoking access may limit our ability to deliver or continue certain Services.

6.3 Security and credential handling

Magmira uses reasonable administrative, technical, and organizational measures designed to protect credentials and client materials. No method of storage or transmission is completely secure. You accept the risks inherent in sharing account credentials for a done-for-you application service.

We encourage you to use strong, unique passwords and to change passwords after your engagement ends if you wish. Upon request or when your engagement ends, we will stop using your credentials and delete or return them according to our Privacy Policy, subject to legal retention requirements.

6.4 Refusal and suspension

Magmira may refuse to submit any application or access any account that appears inaccurate, misleading, fraudulent, unlawful, or outside your agreed scope. Failure to provide working credentials or required Drive access may delay or pause Services and may affect refund eligibility under our Refund Policy.

7. Acceptable Use

You may not use the Services to misrepresent your qualifications, falsify information, create fraudulent documents, submit applications for another person without authorization, interfere with security, reverse engineer our tools, copy proprietary systems, or use the Services unlawfully.

A violation of this section may result in suspension or termination without refund.

8. Magmira Platform Accounts

If you create a Magmira website account, you are responsible for maintaining the confidentiality of your Magmira login credentials and for all activities under that account.

This Section 8 applies to your Magmira platform account only. Access to your job search email and job board accounts is governed by Section 6.

You must promptly notify us of any suspected unauthorized access or security incident involving your Magmira account or any credentials you have shared with us.

9. Software, Automation, and Beta Features

Magmira may offer browser extensions, dashboards, integrations, automation tools, AI assistants, and experimental features.

Third-party websites and platforms may change functionality at any time, and software features may not always operate without interruption or error.

Beta or early-access features are provided on an "as is" basis.

10. AI-Assisted Features and Automated Processing

Magmira may use artificial intelligence, machine learning, and automation tools to support resume optimization, drafting, job matching, skills extraction, analysis, application workflows, and related service activities.

These processes are designed to assist — not replace — human review. Our team reviews and oversees application materials and submissions before they go out. The final hiring decision always rests with the employer, not Magmira or our AI tools.

AI-generated outputs may contain errors, omissions, or outdated information, and you remain responsible for reviewing all final materials before use.

Magmira does not use AI to make hiring decisions on behalf of employers.

If you believe automated processing has significantly affected you in a way that produces legal or similarly significant effects, contact hello@magmira.com to request human review where applicable law provides that right.

11. Intellectual Property

Magmira owns all rights in its workflows, prompts, templates, systems, methodologies, automation logic, software, content, branding, and proprietary materials, except for materials you provide.

You retain ownership of the documents and information you upload, but you grant Magmira a limited license to host, store, process, modify, and use those materials solely to provide the Services.

You may not copy, resell, redistribute, publish, license, or replicate Magmira's proprietary materials without written permission.

12. Third-Party Services and Platforms

The Services may interact with or reference third-party platforms such as LinkedIn, Indeed, Workday, Greenhouse, Lever, Google, Microsoft, and employer career portals.

Magmira is not affiliated with, endorsed by, or sponsored by those third parties unless expressly stated.

You are responsible for complying with the terms, policies, and acceptable-use rules of any third-party platform connected to your job search, including platforms where applications are submitted or where you maintain a profile we optimize.

We are not responsible for third-party outages, policy changes, account restrictions, application form changes, platform bans, or service interruptions caused by third parties — including actions taken by an employer or platform in response to applications we submit at your direction.

13. Payments and Billing

Fees are billed in U.S. Dollars as one-time payments under the plan or service you select. Magmira does not offer month-to-month subscription billing for service plans.

If payment is not received, we may suspend or terminate access to the Services and pursue lawful collection of unpaid amounts.

14. Cancellation and Refunds

Your cancellation and refund rights are governed by our Refund Policy, which is incorporated into these Terms by reference.

15. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

16. Termination

We may suspend or terminate your access to the Services if you violate these Terms, fail to pay, engage in fraud, create legal risk, or misuse the platform.

17. Disclaimers

The Services are provided on an "as is" and "as available" basis to the maximum extent permitted by law.

Magmira disclaims all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.

18. Limitation of Liability

To the maximum extent permitted by law, Magmira will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, lost business, lost data, or reputational harm.

Magmira's total liability for any claim arising out of or relating to the Services will not exceed the greater of the amount you paid for the specific service giving rise to the claim or $500 USD.

19. Indemnification

You agree to defend, indemnify, and hold harmless Magmira and its affiliates, owners, officers, employees, contractors, and service providers from claims, liabilities, damages, and expenses arising from your use of the Services, your content, your submitted information, activity conducted through accounts or credentials you authorized, or your violation of these Terms or third-party platform rules.

20. Export Compliance

You represent that you are not located in a comprehensively sanctioned jurisdiction, are not on a restricted or denied-party list, and will not use the Services in violation of applicable export control or sanctions laws.

21. Electronic Communications

You consent to receive communications electronically, including by email, platform notification, and other digital means.

You agree that electronic notices and signatures satisfy legal requirements for written communications and signatures to the extent permitted by law.

22. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Before filing a legal claim, both parties agree to attempt good-faith informal resolution by contacting hello@magmira.com.

If a dispute cannot be resolved informally, it may be brought in a court of competent jurisdiction in Texas.

To the maximum extent permitted by law, both parties waive any right to participate in a class action or representative proceeding.

23. Modifications to These Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms at https://magmira.com/terms and update the "Last Updated" date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires your affirmative consent.

If you do not agree to updated Terms, you must stop using the Services and contact us regarding any active engagement.

24. Severability and Assignment

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

You may not assign or transfer your rights under these Terms without our prior written consent. Magmira may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

25. Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, and any applicable order form, engagement confirmation, or written agreement, form the entire agreement between you and Magmira regarding the Services and supersede prior oral or written understandings about the same subject matter.
